Applicant Privacy Notice

1. Introduction

We respect the privacy rights of individuals and are committed to protecting your privacy and handling your personal information responsibly and in accordance with applicable law. It is important that you read all of this Notice carefully as it sets out how Sisense (“Sisense”, the “Company”, “we” or “us”) handles your personal information when you apply for a job or other role with us, and the rights you have in connection with that information.

Kindly note that the precise data controller in respect of your personal information will typically be the Sisense entity to which you are applying, although other entities in the Sisense group may access and process your information for the purposes set out in this Notice.

The term “applicant” is used in this Notice to refer to anyone who applies for a job role and/or internship opportunities, or who otherwise seeks to carry out work with or for us (whether on a permanent or non-permanent basis).

If you are a resident in the European Economic Area (“EEA”) or the United Kingdom (“UK”), please also refer to Sections ‎4 and ‎6 below for additional information that applies to you.

2. Types of personal information we collect when you apply

Information that we collect automatically

You can visit the Careers section of our website at: https://www.sisense.com/careers/ (the “Website”) and search for jobs without providing personal information. However, we do collect certain personal information automatically from your device when you visit our Website.

Personal information collected from you

To process your application, we ask you to provide personal information about yourself. All personal information is provided on a voluntary basis, and you determine the extent of information you provide to Sisense. However, some personal information may be necessary to complete an evaluation of your application, and if it is not provided, our ability to consider you as a candidate may be limited.

The types of personal information we may collect and process when you apply for a role with us include (but not limited to):

  • Identification data and contact information – including your name, address, email address, phone number and other contact information;
  • Employment history – such as previous employers and job titles/positions;
  • Background information – such as academic/professional qualifications, job qualifications, education, details included in your CV/resume (which might include details of any membership or interests constituting sensitive personal information), transcripts and employment references, information about criminal convictions and offences (where allowed under applicable law) and background checks results;
  • National identifies – immigration/visa status;
  • Previous applications/roles – information relating to previous applications you have made to the Company and/or any previous employment history with the Company;
  • Details of your nominated referees – including their name, contract details, employer and job role; and
  • Other information you may voluntarily provide throughout the recruitment process – including through interviews, such as date of birth and gender.

As a general rule, during the recruitment process, we try not to collect or process any information that reveals your racial or ethnic origin, religious, political or philosophical beliefs or trade union membership, genetic data, biometric data for the purposes of unique identification or information concerning your health/sex life (“Sensitive Personal Information”), unless authorized by law or where necessary to comply with the applicable law.

However, in some circumstances we may need to collect, or request on a voluntary disclosure basis, some Sensitive Personal Information for legitimate recruitment-related purposes. For example: information about your disabilities for the purposes of equal opportunities monitoring. You may provide, on a voluntary basis, other Sensitive Personal Information during the recruitment process.

Personal information collected from other sources

Depending on your residency, we may collect some information from sources other than you in the course of our recruitment process, including:

  • Information provided by background checking agencies and other external database holders (for example, credit references agencies and professional/other sanctions registries);
  • References provided by referees;
  • Other background information provided or confirmed by academic institutions and training or certification providers;
  • Criminal records data obtained through criminal records checks;
  • Information provided by recruitment or executive search agencies; and
  • Information collected from publicly available sources, including any social media platforms you use or other information available online.

3. Purposes for processing personal information

We collect and use this personal information primarily for recruitment purposes – in particular, to determine your qualifications and suitability for employment with us and to reach a hiring decision. This includes assessing your skills, qualifications and background for particular roles, verifying your information, carrying out reference checks or background checks and to generally manage the hiring process and communicate with you about it. We may also process your personal information in order to comply with corporate governance and other legal and regulatory requirements.

If you are accepted for a role at the Company, the information collected during the recruitment process will form part of your ongoing staff member record and will be processed in accordance with the Company’s applicable Staff Privacy Notice.

If you are not successful, we may still keep your application to allow us to consider you for other suitable openings within the Company in the future unless you tell us that you do not want us to do so, and subject to Section ‎7 of this Notice.

4. Legal basis for processing personal information (for EEA/UK applicants only)

Under EEA and UK data protection laws, our legal basis for processing your personal information as part of the recruitment process is:

  • Our legitimate interests (as summarized in Section ‎3 of the Notice), where those interests are not overridden by your data protection interests or fundamental rights and freedoms, particularly taking into consideration the safeguards that we put in place;
  • To comply with applicable immigration and/or employment laws and regulations;
  • To take steps prior to entering an employment contract with you, where you are considered for employment;
  • In circumstances where you have made the data public;
  • Where we have your consent to do so. Where we have requested your consent to process your personal information, you have the right to withdraw your consent at any time; and
  • To protect the rights and interests of the Company, our employees, applicants and others, as required and permitted by applicable law.

If we ask you to provide personal information to comply with a legal requirement or to perform a contract with you, we will make this clear at the relevant time and advise you whether the provision of your personal information is mandatory or not (as well as of the possible consequences if you do not provide your personal information).

5. Who we share your personal information with

We take care to allow access to personal information only to those who require such access to perform their tasks and duties, and to third parties who have a legitimate purpose for accessing it. Whenever we permit a third party to access personal information, we will implement appropriate measures to ensure the information is used in a manner consistent with this Notice and the applicable law, and that the security and confidentiality of the information in maintained.

Transfer to third party service providers

We may make certain personal information available to third parties who provide services relating to the recruitment process to us, including:

  • Recruitment or executive search agencies involved in your recruitment;
  • Background checking or other screening providers and relevant local criminal records checking agencies;
  • Our personality profiling partners;
  • Data storage, shared services and recruitment platform providers, IT developers and support providers and providers of hosting services in relation to our Website; and
  • Other third parties who provide support and advice including in relation to insurance and security.

We may also disclose personal information to third parties on other lawful grounds, including:

  • Where you have provided your consent;
  • To comply with our legal obligations, including where necessary to abide by law, regulation or contract or to respond to a court order, administrative or judicial process, including, but not limited to, a subpoena, government audit or search warrant;
  • In response to lawful requests by public authorities (including for tax, immigration, health and safety, national security or law enforcement purposes);
  • As necessary to establish, exercise or defend against potential, threatened or actual legal claims;
  • Where necessary to protect your vital interests or those of another person; and
  • In connection with the sale, assignment or other transfer of all or part of our business.

6. Transfers abroad (for EEA/UK applicants only)

In some cases, the sharing described in the Notice may result in your personal information being transferred internationally, including to countries outside the EEA or the UK. These countries may have data protection laws that are different than the laws that apply to the EEA/UK (and, in some cases, may not be as protective).

However, we have taken appropriate safeguards to require that your personal information will remain protected in accordance with this Notice, including by implementing with third parties based outside the EEA/UK (as applicable), who may receive your personal information, the European Commission’s Standard Contractual Clauses (under Article 46(2) of the General Data Protection Regulation) or the “UK Addendum to the EU Standard Contractual Clauses” issued by the Information Commissioner’s Office under s.119A(1) of the Data Protection Act 2018, as applicable.

You may exercise the rights available to you under applicable data protection laws. These may include (subject to the data protection laws that apply to you):

  • The right to access, correct, update or request deletion of your personal information.
  • The right to object to processing of your personal information, the right to ask us to restrict processing of your personal information and/or the right to request portability of your personal information.
  • If we have collected and process your personal information with your consent – the right to withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your personal information conducted in reliance on lawful processing grounds other than consent.
  • The right to complain to your local data protection authority about our collection and use of your personal information. For more information, please contact your local data protection authority.

To protect your privacy and security, we may take reasonable steps to verify your identity before granting access or making corrections. We respond to all requests we receive from individuals wishing to exercise their data privacy rights in accordance with applicable data protection laws.

7. Data retention periods

Personal information will be stored in accordance with applicable laws and kept as long as needed to carry out the purposes described in this Notice, unless a longer retention period is permitted or required by applicable law. We may also retain your personal information in accordance with applicable law to consider you for other job opportunities, unless you have told us that you do not wish us to retain your information for such purposes. Generally this means your personal information will be retained for a reasonable period after confirmation that your application was unsuccessful. If you’re successful in your application for a position at Sisense, we retain the personal information you provide during the application process, and information about your application process, as part of your employee records, and as further described in the Company’s applicable Staff Privacy Notice.

We give you the opportunity to let us know if you do not want us to use your information for these purposes at the time that you provide your details to us.

You can request deletion of your personal information at any time (see Part III for further information) and we will consider your request in accordance with applicable laws.”

The Website may provide links to or the ability to connect with third-party websites, services, social networks, applications or social media features (“Application Features”). Connecting with such Application Features may allow the applicable third party to process your personal information, and this Notice does not cover processing activities by such third-parties. Please review the privacy notice of the applicable third party prior to interacting with them or providing them with your personal information for the purpose of submitting your application.

9. Changes to this Notice

We may update this Notice from time to time in response to changing legal or technological developments and/or our business needs. When we update this Notice, we will note the date of its most recent revision above. If we make material changes to this Notice, we may take appropriate measures to inform you in a manner that is consistent with the significance of the changes we make. We encourage you to review this Notice frequently to be informed of how Sisense is protecting your personal information.
